Terms and Conditions of Sale
General
Marcolino Sebo Wines and Oils, Lda is a private wine producer in the Alentejo region, founded in 1975 with approximately 130 hectares of vineyards located between Borba and Estremoz.
These Terms and Conditions of sale are agreed between Marcolino Sebo Wines and Oils, Lda, with registered office at QUINTA DA PINHEIRA, ARCOS, 7100-031 – ESTREMOZ, PORTUGAL, tax identification number 501 248 560, telephone contact (+351) 268 891 570 and email loja@marcolinosebo.com, hereinafter referred to as “Marcolino Sebo”, and the people who wish to make purchases through the website marcolinosebo.com hereinafter referred to as "User".
The parties agree that purchases made through the website marcolinosebo.com All terms and conditions will be governed exclusively by this contract, excluding any conditions previously available on the website.
Online Store / Website – Access and Use
By accessing the Marcolino Sebo online store, the customer implicitly declares to be over 18 years of age and not to have any legal impediment and/or restriction that prevents them from purchasing alcoholic beverages.
Marcolino Sebo reserves the right to revoke access to the online store if it detects that the user does not meet the legal requirements.
Purchase – Processing
Purchasing wines from Marcolino Sebo through the online store is only available in Portuguese; however, it is possible to consult and request information about the wines in English directly on the website.
Stocks - Availability
Items for sale in the online shop are subject to existing stock and orders will be processed by order of arrival.
In case of stock breakdown, temporary or permanent, the customer will be duly contacted and warned, being suggested an alternative products with similar characteristics.
Articles – Prices
Product prices are listed in € (euros) and include VAT at the current legal rate.
Payment
Marcolino Sebo's online store offers customers the following payment options:
- Bank transfer;
- Payment by bank slip;
- Payment by Credit Card (Visa, Mastercard, American Express).
In the case of credit card payments, the transaction is processed securely through the Stripe platform.
Order – Confirmation and Status
After the purchase is completed, the customer will receive an order confirmation email. This email will also contain the necessary payment information, according to the chosen method. Once the order is paid, you will receive another email notifying you.
Each order has an associated status, which varies depending on the stage of the purchase process.
- Awaiting Payment: The order was successfully placed, but the payment has not yet been processed.
- In processing: the order was successfully placed and the payment has already been processed.
- Completed: The order has already been shipped or delivered.
- Cancelled: The order was registered but cancelled before payment was made, therefore the order will not be processed.
- Refund: The order was registered, but returned after payment was made.
- Declined: The credit card used to pay for the order was not authorized, therefore the order will not be processed.
Transportation – Delivery Conditions and Times
Marcolino Sebo has suitable packaging for transporting merchandise, designed to effectively protect its contents.
Marcolino Sebo products are shipped via a transport company, and deliveries are available throughout mainland Portugal.
Depending on whether the delivery address is in mainland Portugal, the following delivery times are expected:
- Marcolino Sebo does not guarantee these delivery times during promotional periods, Christmas, and stock shortages.
- Deliveries are made between 9am and 6pm, Monday to Friday.
Delivery – Costs
The delivery cost is fixed at 9.49€. Marcolino Sebo will not pass this cost on to the customer for purchases over 90€, but reserves the right to revoke this condition at any time without prior notice. The validity of the free shipping offer can be confirmed through information visible in the shopping area of the website.
The prices shown include fuel surcharge (3%), SCUTS surcharge (2.1%) and VAT (at the current legal rate).
Damaged Merchandise
Marcolino Sebo is responsible for delivering products in good condition and is available to address any complaints.
In the event that orders are not delivered in good condition, the customer must inform the carrier and send an email to Marcolino Sebo at the following email address: loja@marcolinosebo.com specifying the issue, so that the situation can be rectified as quickly as possible.
Marcolino Sebo will conduct an analysis of the product non-conformity and reserves the right to approve or reject the complaint based on the results of the analysis.
In cases of non-compliance, Marcolino Sebo commits to providing the customer with a credit equal to the value of the product, which can be used to purchase any other product available in the online store.
Cancellation and Returns
If the customer wishes to cancel or return the order, he must contact Marcolino Sebo immediately via the email address loja@marcolinosebo.com specifying the subject matter as well as the reason for the cancellation or return.
In the case of cancellation, the customer has up to 24 hours after payment is made to request cancellation of the order (after this period the order may have already been shipped, therefore it will be treated as a return).
In the case of returns, the customer will receive an email with information on the procedures to follow for the return, which must be completed within the legal period of 14 days after receiving the order.
Marcolino Sebo reserves the right to accept returns only for products that are in proper condition.
According to Article 4 of DL143/2001, the consumer has the right to withdraw from the contract freely under the following terms:
In distance contracts, the consumer has a minimum period of 14 days, from the date of receipt of the goods, to cancel the contract without paying compensation and without needing to state a reason, by sending a registered letter with acknowledgment of receipt communicating this intention. The price of the goods will be refunded to the consumer within a maximum period of 30 days, less return shipping costs. The goods must be returned in proper condition for use (including the original packaging and provided that the bottles have not been opened).
Applicable law
1. These general terms and conditions, and all disputes arising from or related to them, including their validity, the use of the website, or any purchase made on the website, shall be governed by Portuguese law, specifically Decree-Law No. 24/2014 of February 14, as amended by Law No. 47/2014 of July 28.
2. All purchases made on the Marcolino Sebo website are subject to Portuguese law, and any conflict or divergence in the interpretation of the General Terms and Conditions of Online Sale will be submitted to the competent Portuguese court.
3. In accordance with and for the purposes of Article 18 of Law No. 144/2015, of September 8, we inform you that the available ADR entity is CNIACC – Centro Nacional de Informação e Arbitragem de Conflitos de Consumo, with the following contact details:
